Public affairs analyst, Barr. Akugbe J. Osayande has described as executive lawlessness and rascality the refusal of State governors to implement executive order 10 on financial autonomy to State judiciary as signed by President Muhammadu Buhari.

President Buhari had on Friday, May 22, 2020, signed the executive order 10 which granted financial autonomy to state assemblies and judiciary but State governors in a swift reaction held a meeting with President Buhari and attorney general of the Federation Abubakar Malami over the interpretation of the order.

The executive order mandated the state governors to always include the allocations of the legislature and the judiciary in the first-line charge of their budgets but the governors, who met under the aegis of Nigeria Governors’ Forum (NGF), rejected the president’s order and described it as an unnecessary distraction.

This development had forced members of the Judicial Staff Union of Nigeria (JUSUN), and the Parliamentary Staff Association of Nigeria (PASAN) to embark on a nationwide indefinite strike forcing the closure of Federal High Courts in different states across the nation.

But legal expert, Barr. Osayande maintained that the governors by reason of their refusal to honor the dictate of the constitution on judicial independence have violated the oath of their office which they swore to uphold the constitution.

Speaking on the principle of separation of powers, Barr. Osayande insisted that since the constitution had contemplated that the three arms of government should be separate and independent, financial autonomy remains a very important component of independence and should be respected by the State executives.

“There’s no way the judiciary can be independent if they are still tied to the apron string of the governors to get the money that belongs to them. I can’t be independent of you when every time I need money you are the one giving me. So the law has given everybody that fraction of independence.

“What the governors are doing is contempt of court. The same court that made many of them who lost elections governors has given them an order to follow what the constitution says, yet they refused,” he said.
